Access to the web site is subject to the user's acceptance and agreement with the terms, conditions, notices and disclaimers contained herein. Use of, and/or access to, the web site constitutes agreement to the Terms of Use. The Project owner reserves the right to amend the Terms of Use at any time. User licence to The Project

Termination

The Terms of Use are effective until terminated by The Project, and The Project may terminate this agreement and users' access to the web site at any time without notice. In the event of termination, users are no longer authorised to access the web site, but all restrictions imposed on the user, licenses granted by the user and all The Project disclaimers and limitations of liability set out in the Terms of Use will survive.

Miscellaneous

The Project relies on the user's continued observance of these Terms of Use. If The Project suffers any loss or damage or incurs any costs in connection with any breach of these Terms of Use or any other legal obligation then the user agrees to indemnify The Project for those losses, damages and costs. This agreement will be governed by and construed in accordance with the laws the Australian Capital Territory, Australia, where The Project is hosted. The user irrevocably and unconditionally submits to the non-exclusive jurisdiction of the courts of the Australian Capital Territory. If any provision of this agreement is found to be invalid or unenforceable by a court of law, such invalidity or unenforceability will not affect the remainder of the agreement, which will continue in full force and effect. 2. The Promoter is Melrose Laboratories Pty Ltd (A.B.N 54 005 490 102) of 4 Redland Drive, Mitcham, Vic 3132.

3. Competition entry is open to Australian residents only. Employees of Melrose Laboratories Pty Ltd, anyone else connected to Melrose Laboratories and their immediate families are ineligible to enter. Eligible people (Entrants) who enter online at www.melrosefoods.com in accordance with these Conditions of Entry will be eligible to win. Three (3) Entrants will be selected as the winners.

4. To enter, a person must submit an entry by email to info@melrosehealth.com.au or in writing to 4 Redland drive Mitcham Vic 3132 during the competition period. Only one (1) entry per person is allowed.

5. The entry submitted will be taken as the Entrant's acceptance of assigning all rights and interests including but not limited to copyright and all other intellectual property rights of the Entrant's to Melrose Laboratories. Melrose Laboratories reserves the right to edit or alter the Entrant's submission.

6. Each prize is valued at $170 (Australian Dollars). Prizes will be awarded by mail, sent to the winner's address by registered post. Each prize consists of one hamper of Melrose products

7. The prize will be awarded to the entrants whose recipe, in the opinion of the judges, best answers the question Do you have Australia's Favourite healthy food recipe. Each entry recipe must contain at least one Melrose product as an ingredient

8. Competition commences 00:01 (AEST) on 01/04/2011. Entries close 5.00pm (AEST) on 30/06/2011 (the Competition period). Any entry received after that date will be ineligible. Entry by any person will be taken as acceptance of these Terms and Conditions. There will be three prizes awarded which will be conducted at 10.00am (AEST) on 11/07/2011 at the Promoter's office. The judges' decision is final and no correspondence will be entered into.

9. The winning entries will be notified in writing and by phone on the 30/07/2011.

10. Each winner has until 14/08/2011 to claim their prize. If the winner fails to respond in writing by this date, they forfeit the prize.

11. If the winner of a prize is under the age of 18 years, the prize will be awarded to the winner's nominated parent or guardian.

12. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of the prize.

If for any reason this Competition is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures, or other causes that corrupt or affect the administration, security, fairness, integrity or proper conduct of this Competition, Melrose Laboratories reserves the right, in its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend this Competition.
